New Comments

At today's Family Meeting held in Ridgewood, NJ with Special Master Kenneth Feinberg, it was stated that additional comments would be allowed up until around Feb 1. Here are mine:

My wife was killed in WTC2 while a visitor to a brokerage firm. We were a two income household. The Interim Rules exclude two key points that will apply to my situation:

1) The rules as they describe the "consumption factor" that is deducted from economic damages are not specific. In two-income households, the percent of the victim's salary that would be applied toward 'consumption' that is assumed in the model would be at most half of what was deducted. In the Final Rules, please clarify how the Consumption Factor is determined and be specific for one versus two income households.

2) The Economic Damage formula does not take into consideration the loss of earnings potential and limited advancement of the surviving working spouse. My career is now derailed and my earnings potential is much less than before Sept. 11. How and where would this be applied?

Thank you.
