The U.S. Court of Appeals for the Fifth Circuit issued a decision, March 17, 2008, affirming the district court's denial of defendants' motion to dismiss. On March 31, 2008, defendant Yeager, along with defendants Shelby and Hirko filed a petition for rehearing en banc. On April 14, 2008, the Fifth Circuit issued an order denying the defendants' petition for rehearing on banc.
A pretrial conference has been set for Monday, September 8, 2008 at 9:30 a.m. before Judge Vanessa D. Gilmore in Courtroom 9A, United States Courthouse, 515 Rusk Avenue, Houston Texas. Jury selection and trial are set for Monday, January 12, 2009, at 1:30 p.m.
