RE: Complaint Number X Dear Mr. X: The Department of Justice has completed its review of the complaint you filed against the City of New Rochelle, New York, alleging violations of Title II of the Americans with Disabilities Act (ADA). You asserted that various physical disabilities prevent you from carrying your garbage to the curbside, and that you needed doorside pickup as a modification for your disabilities. Since the City does not provide doorside service, you alleged that you have been discriminated against on the basis of disability. The Department notified the City of your allegations, and engaged in alternative dispute resolution as a means of resolving the issues in your complaint. As a result of several discussions with City officials, during which the Department clarified the requirements of the ADA, the City of New Rochelle has adopted a program providing for garbage service modifications for persons with disabilities. The program will benefit persons like yourself whose disabilities prevent them from placing their garbage at the curbside. The service offered by the City will now provide garbage pickup from your doorside. We have discussed the elements of this program with you prior to its implementation, and you agreed that it will resolve the issue that generated your complaint.
