U.S. Department of Justice Civil Rights Division Disability Rights Section P.O. Box 66738 Washington, DC 20035-6738 October 23, 1996 Lewis Steinbrecher City Manager 112 West Cass Street P.O. Box 90 Albion, Michigan 49224-0090 Re: Complaint Number XX Dear Mr. Steinbrecher: This letter is in reference to the complaint filed with our office alleging that the wheelchair accessible entrance into the City Hall has been locked on numerous occasions, thus making the City Hall, and the City Council meetings that take place in the City Hall, inaccessible to persons with mobility impairments in violation of title II of the Americans with Disabilities Act of 1990 (ADA). We have received information from you indicating that the City of Albion has provided duplicate "keys" to the City Hall's accessible entrance just inside the accessible entrance and inside the mail room, which is near the accessible entrance and is always unlocked. City Hall staff has been made aware of the location of these "keys." The City has also initiated the installation of an intercom system outside the accessible entrance that will alert the dispatch center of the Albion Department of Public Safety that a person is standing outside the accessible entrance and needs it to be unlocked. Based on the foregoing information, we have concluded that the allegations against the City of Albion have been resolved. Please note that, if the complainant is dissatisfied with our determination, he may be entitled to file a private complaint in the United States District Court under title II of the ADA. This letter does not address other potential claims of discrimination on the basis of disability that may arise from the activities of the City of Albion. Rather, this letter is limited to the allegations presented in the complaint filed with us. Sincerely, Naomi Milton Attorney Disability Rights Section cc: XXX 01-00449
