As you know the complaint alleged that the owners or operators of this station discriminated against a person with a disability by refusing to come to his vehicle in order either to provide service or to accept payments. You have indicated in your response letter, which we received on April 13, 1993, that your facility is a small family owned self-serve gas station and that, when possible, your employees provide gas dispensing services for persons requiring assistance at self-serve prices. You have also indicated that there are generally two or three employees on duty during certain shift, although only one employee is on duty during certain shifts. While the information obtained to date does not necessarily indicate that structural changes are necessary to resolve this matter, we nonetheless believe that instituting the following policies will adequately resolve and prevent the violations alleged in this complaint: 1. Within thirty days of receipt of this letter, you will install signage at each pump stating, "Persons with disabilities may blow their horn for assistance. Service not available if only one attendant is on duty." 01-07433 - 2 - 2. You will institute a policy and instruct all present and future employees that, when more than one attendant is on-duty, pumping service must be provided on a timely basis to persons with disabilities requesting assistance; 3. When pumping services, as required by paragraph 2 above, are provided, no additional charges will be imposed over the normal self-serve price charged for comparable products.
