U.S. Files Civil Suit Alleging Drug Control Violations Against Former Owner Of Marlborough Pharmacy


June W. Stansbury, Special Agent in Charge of the Drug Enforcement Administration in New England and Kevin J. O’Connor, United States Attorney for the District of Connecticut, today announced that the United States has filed a civil suit against ROBERT JENCO, R.Ph., of 33 Insalaco Drive, Windham, Connecticut, former owner and operator of Marlborough Pharmacy, of 2-A Independence Drive, Marlborough, Connecticut, and Marlborough Pharmacy, Inc., for alleged violations of the Controlled Substances Act.

In the Complaint, the Government alleges that, on approximately 216 instances between May 2, 2003, and continuing until on or about June 18, 2004, JENCO and/or Marlborough Pharmacy failed to exercise their corresponding responsibility imposed under the Controlled Substances Act to verify the prescriptions that were filled at the pharmacy were issued in the usual course of professional treatment.

The law imposes responsibility for proper prescribing and dispensing of controlled substances is upon the prescribing practitioner, but a corresponding responsibility rests with the pharmacist who fills the prescription.

The Government is asking that the Court impose the maximum civil penalty of $5,400,000.00. The case has been assigned to U.S. District Court Judge Christopher F. Droney in Hartford.

This case was investigated by the Drug Enforcement Administration – Office of Diversion Control in Hartford, and the State of Connecticut Department of Consumer Protection, Drug Control Division.
