Ex-NFL Player Sentenced for Cocaine Distribution

MAY 26 -- DENVER, CO –Bill Leone, United States Attorney for the District of Colorado, and Jeffrey D. Sweetin, Special Agent in Charge of the Drug Enforcement Administration (DEA) Rocky Mountain Division, announced today that TIMOTHY SMITH, age 42, of Denver, was sentenced today by Chief U.S. District Court Judge Lewis T. Babcock to serve 30 months in federal prison for cocaine distribution.  Judge Babcock also noted that SMITH is required to pay $88,000 in unpaid child support.  SMITH, who is free on bond, was ordered to report to facility designated by the Bureau of Prisons by July 10, 2006.  TIMOTHY SMITH’s brother, CHRISTOPHER SMITH, age 35, of Lakewood, was previously sentenced by Chief Judge Babcock to serve 5 years of probation.

TIMOTHY and CHRISTOPHER SMITH were charged by Criminal Complaint on October 3, 2005 following their arrest by Drug Enforcement Agents.  Both were indicted by a federal grand jury in Denver on October 31, 2005.  TIMOTHY SMITH pled guilty to cocaine distribution on March 9, 2006.  CHRISTOPHER SMITH pled guilty to aiding and abetting cocaine distribution on February 24, 2006.  Chief Judge Babcock sentenced CHRISTOPHER SMITH to serve 5 years of probation on May 12, 2006.
