friendly page] Federally For Growing Marijuana Resulting In Numerous Halloween Arrests NOV 8 -- (London, KY)— Amul R. Thapar, United States Attorney for the Eastern District of Kentucky, Richard Putnam, Resident Agent in Charge, Bureau of Alcohol, Tobacco, Firearms & Explosives (Lexington Field Division), Robert L. Corso, Special Agent in Charge, Drug Enforcement Administration, Ed Shemelya, Cannabis Suppression, Kentucky State Police, Wendy Haney, Supervisory Special Agent, United States Forest Service, London, Kentucky, David Gilbert, Director of Lake Cumberland Drug Area Task Force and C.Frank Rapier, Director of Appalachia High Intensity Drug Trafficking Area and Tracy A. Reinhold, Special Agent in Charge, Federal Bureau of Investigation, announce that on October 26, 2007, a federal grand jury in London, Kentucky returned indictments on the following persons, in cooperation with the 2007 Marijuana Eradication Program. Kenny Bray, 40, Leslie County, Kentucky; Roger Gail Crabtree, 42, Wayne County, Kentucky; Johnny D. Owens, 53, Rockcastle County, Kentucky; Dustin Edward Randolph, 20, McCreary County, Kentucky; James G. Reece, 42, Whitley County, Kentucky, Timothy John Morgan, 39, Whitley County, Kentucky; Charles Mounce, 47, Pulaski County, Kentucky and Billy Joe Rogers, 48, Floyd County, were all indicted by a federal grand jury for knowingly and intentionally manufacturing, less than 50 plants of marijuana, a Schedule I controlled substance, in violation of 21 U.S.C. § 841(a)(1). These individuals face a penalty of not more than 5 years in prison and a fine of $250,000. Morgan, Mounce and Rogers were also charged with federal firearm violations. James Allen Carter, 40, Whitley County, Kentucky; Mearl Sharp, 38, Leslie County, Kentucky; McKinley Nolan, 39 Clay County, Kentucky; Frank Vibbert, 37, Laurel County, Kentucky, were all indicted by a federal grand jury for knowingly and intentionally manufacturing more than 50 plants of marijuana, a Schedule I controlled substance, in violation of 21 U.S.C. § 841(a)(1). These individuals face a penalty of not more than 20 years in prison and a fine of not more than $1,000,000. Nolan and Vibbert were also charged with federal firearms violations. Freddie Ray Freeman, 48, Harlan County, Kentucky; Gary Mays, 51, Garrard County, Kentucky; Orvis Spencer Jr., 51, Lee County, Kentucky; Albert Trent, 39, Wolfe County, Kentucky; and Nathan Paul Hurd, 21, McCreary County, Kentucky; were all indicted by a federal grand jury for knowingly and intentionally manufacturing 100 or more plants of marijuana, a Schedule I controlled substance, in violation of 21 U.S.C.§ 841(a)(1). These individuals face a penalty of nor less than 5 years and not more than 40 years in prison and a fine of not more than $2,000,000. Freeman and Mays, were also charge with federal firearm violations. Michael Shane Gabbard, 37, Kathy Diane Baker, 45, Indgrid Dekauwe, 43, Christopher Matthew Muncy, 28 and Jerry Levi Muncy, 52 all from Rockcastle County, Kentucky, were indicted by a federal grand jury for conspiracy to knowingly and intentionally manufacture, 100 or more marijuana plants, a Schedule I controlled substance, a violation of 21 U.S.C. § 846(a)(1). They all face a penalty of not less than 5 years and not more than 40 years in prison and a $2,000,000 fine. Gabbard is facing an additional 5 years consecutive to his drug penalty due to a federal firearm charge. David Holland, 61, Leslie County, Kentucky, was indicted by a federal grand jury for knowingly and intentionally manufacturing, more than 1000 plants of marijuana, a Schedule I controlled substance, in violation of 21 U.S.C. § 841(a)(1). Holland is also facing federal firearm violations. Holland is facing a penalty of not less than 10 years and not more than life in prison and a fine of $4,000,000. Carl Ray Smith, 43 and Sabrina Kay Johnson, 34, both of Laurel County, Kentucky, were indicted for knowingly and intentionally manufacturing 100 or more plants of marijuana, a Schedule I controlled substance, a violation of 21 U.S.C. § 846. They are facing a penalty of not less than 5 years and not more than 40 years in prison and a fine of not more than $2,000,000. The indictment of a person by a grand jury is an accusation only, and that person is presumed innocent unless proven guilty. |
