LAS VEGAS TAX-RETURN PREPARER ARRESTED

Preparer Of Fraudulent Returns Held For Civil Contempt Of Court

WASHINGTON, D.C.-The Justice Department announced today that the U.S. Marshals Service has arrested Jeffrey Dean Hubacek, a former Las Vegas tax-return preparer, for civil contempt of court. In June, a federal court in Nevada ordered Hubacek’s arrest after he failed to comply with a federal court order requiring him to provide the Justice Department his customers’ names, mailing and e-mail addresses, and phone and Social Security numbers.

After finding in June 2004 that Hubacek prepared fraudulent federal income tax returns for his customers, the U.S. District Court for the District of Nevada permanently barred him from preparing income tax returns and ordered him to provide customer information to the government. The returns Hubacek prepared falsely claimed the customers were not liable for income taxes on their wages. When Hubacek failed to provide the customer information to the government, the court in February entered a civil contempt of court order against Hubacek.

“The Justice Department and the IRS are working diligently to stop the promotion of tax fraud and the preparation and filing of fraudulent returns,” said Assistant Attorney General Eileen J. O’Connor. “Important to this effort is identifying the customers of fraudulent return preparers.”
