OAKLAND – United States Attorney Scott N. Schools announced that Everett Allen Robinson pleaded guilty yesterday to attempted armed bank robbery and brandishing of a firearm during the attempted robbery.
In pleading guilty, Robinson admitted that he entered the Bank of America in Orinda on March 21, 2007, armed with a shotgun, yelling for everyone to get to the ground. While Robinson’s co-conspirator attempted to access the vault, Robinson brandished a shotgun, ordered people in the bank onto the ground, and stood guard over them. As Robinson was standing guard over people in the front of the bank, a female victim walked up to the front of the bank and attempted to leave. Robinson prevented her from leaving by physically restraining her and ordering her to lie on the floor of the bank.
Robinson is presently in custody, and his sentencing is scheduled for March 11, 2008, at 10:00 a.m., before United States District Judge Saundra Brown Armstrong in Oakland. The maximum statutory penalty for Attempted Armed Bank Robbery in violation of 18 U.S.C. § 2113 is 25 years in prison and a fine of $250,000. Brandishing a firearm in violation of 18 U.S.C. § 924(c) carries a mandatory minimum sentence of 7 years in prison, to run consecutively with the attempted armed bank robbery sentence. Sentence will be imposed by the district court only after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, Title 18, United States Code, Section 3553.
Chinhayi Coleman is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Cynthia Daniel. The prosecution is the result of an investigation by the Federal Bureau of Investigation and the Contra Costa County Sheriff’s Department.
