FORMER WORLD-CLASS CYCLIST TAMMY THOMAS CONVICTED OF PERJURY AND OBSTRUCTION OF JUSTICE

Guilty of False Statements Related to Steroid Use

SAN FRANCISCO – United States Attorney Joseph P. Russoniello announced Tammy Thomas was convicted today by a federal jury of three counts of making false declarations before the grand jury and one count of obstruction of justice. The trial jury, after deliberating for two days, found that Thomas had made material false statements to a grand jury and obstructed justice during her November 6, 2003 grand jury testimony. Thomas was acquitted of two other charges of making material false declarations during her testimony on the same date. The guilty verdict followed a two-week jury trial before United States District Judge Susan Illston. United States Attorney Russoniello expressed appreciation for the dedication and service of the trial jury in this matter.

The sentencing of Ms. Thomas is scheduled for July 25, 2008 at 11:00 a.m. before Judge Illston in San Francisco. The maximum statutory penalty for each count in violation of 18 U.S.C. 1623(a) - False Declarations before the Grand Jury - is 5 years and a fine of $250,000. The maximum statutory penalty for each count in violation of 18 U.S.C. 1503 - Obstruction of Justice - is 10 years and a fine of $250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.

Jeff Nedrow and Matt Parrella are the Assistant U.S. Attorneys who prosecuted the case. This conviction is the result of an investigation by the Internal Revenue Service, Criminal Investigation.
