OAKLAND – United States Attorney Joseph P. Russoniello announced that David Charles Bailey, 38, of San Diego, California, was sentenced today to 151 months imprisonment, 3 years of supervised release, and a $200 special assessment for possessing with intent to distribute 3900 ecstasy pills, in violation of 21 U.S.C. § 841. Bailey was arrested in Oakland, California, on October 11, 2006, with 3000 ecstasy pills, and he previously had been caught with 900 ecstasy pills on April 27, 2006, in San Diego, California.
A federal grand jury in Oakland indicted Bailey on November 30, 2006. Subsequently, in December 2007, a federal grand jury in San Diego indicted Bailey for possession of the 900 pills, then that case was transferred to the court in Oakland. The sentence was for both the crimes in Oakland and San Diego. Bailey was sentenced by United States District Judge D. Lowell Jensen.
Shashi Kewalramani is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Lead Legal Assistant Cynthia Daniel. The prosecution in San Diego was handled by Assistant U.S. Attorney Michael Kaplan. The prosecution is the result of an investigation by the Drug Enforcement Administration in Oakland and San Diego, California.
