SAN FRANCISCO – United States Attorney Joseph P. Russoniello announced that Dr. Bruce Barker was sentenced today to six months in prison, and ordered to serve three years of supervised release following release from custody, for perjury. When he is released from prison, Dr. Barker is to serve six months in home detention. Judge Illston also ordered him to pay a $35,000 fine.
Dr. Barker, 51, a surgeon at Kaiser Hospital in San Francisco, pleaded guilty to perjury on October 31, 2007. According to the plea agreement, Dr. Barker admitted that he knowingly provided false testimony when he testified at a federal criminal jury trial held in the court of U.S. District Judge Susan Illston in November 2002. According to documents filed with the court prior to today’s sentencing, Dr. Barker provided a false alibi during the trial of Marvin Washington, who was indicted by a federal grand jury for being a felon in possession of a firearm.
The six-month prison sentence was handed down by U.S. District Court Judge Susan Illston following Dr. Barker’s guilty plea to one count of making a false declaration before a court in violation of 18 U.S.C. § 1623(a). Judge Illston also sentenced Dr. Barker to serve three years of supervised release after he is released from prison. She also ordered Dr. Barker to pay a fine of $35,000. As conditions of supervised release, Dr. Barker is to serve the first six months in home detention; he is to have no contact at all with Mr. Washington or his family; he is to perform 1,000 hours of community service; he is to undergo mental health treatment; and his to submit to drug testing. Dr. Barker will begin serving his sentence on August 22, 2008. .
Susan Badger and Peter Axelrod are the Assistant U.S. Attorneys who are prosecuting the case with the assistance of Erica Doerr and Beth Margen. The prosecution is the result of investigation by the Federal Bureau of Investigation.
