Absentee Voting for President (Section 202)

Section 202 of the Voting Rights Act, 42 U.S.C. § 1973aa-1, assures the right to vote in Presidential elections of persons who move shortly before election day. Any person, otherwise eligible, must be permitted to register to vote for President if he or she applies at least 30 days before the election, and must be permitted to vote for President by absentee ballot if he or she applies at least 7 days before the election and returns the ballot by the close of the polls on election day. Any person who moves to a new jurisdiction within 30 days of a presidential election must be allowed to vote for President by absentee ballot in his or her old jurisdiction. A three-judge court is required.
