ILLEGAL ALIEN SENTENCED FOR AGGRAVATED IDENTITY THEFT

United States Attorney Matt M. Dummermuth announced today that an illegal alien who used the identification of another person was sentenced today to 24 months and one day in federal person.
CARLOS TZIRIN-RODRIGUEZ, age 26, from Guatemala, received the prison term after a July 16, 2008, guilty plea to one count of possessing a resident alien card not lawfully issued to him and one count of aggravated identity theft.
In a plea agreement, TZIRIN-RODRIGUEZ admitted he possessed a false resident alien card and used the identification of another person without their consent to gain employment at Agriprocessors, Inc. in Postville, Iowa. TZIRIN-RODRIGUEZ entered the United States on about April 1, 2006, at or near San Ysidro, California, with the aid of a smuggler. TZIRIN-RODRIGUEZ was arrested on April 13, 2008, in Waukon, Iowa, and charged with drunk driving. The state charges were later dismissed.
TZIRIN-RODRIGUEZ was sentenced in Cedar Rapids by United States District Court Chief Judge Linda R. Reade. TZIRIN-RODRIGUEZ was sentenced to one day for possessing false identification documents. He was sentenced to a mandatory consecutive sentence of 24 months’ imprisonment for using the identity of another person. A special assessment of $200 was imposed. He must also serve a two-year term of supervised release after the prison term. There is no parole in the federal system.
TZIRIN-RODRIGUEZ is being held in the United States Marshal’s custody until he can be transported to a federal prison.
The case was prosecuted by Assistant United States Attorney Richard L. Murphy and investigated by Immigration and Customs Enforcement.
