MEXICAN NATIONAL SENTENCED SIX MONTHS IMPRISONMENT FOR FALSELY REPRESENTING UNITED STATES CITIZEN
– Defendant will enter deportation proceedings after serving sentence

LOUISVILLE, KY - Rosa Hilario-Colin, a/k/a Joely Santiago Rodriguez, age 26, of Warsaw, Kentucky, was sentenced to 6 months imprisonment in United States District Court , for knowingly falsely and willfully representing herself to be a citizen of the United States and knowingly possessing and using, without lawful authority, a means of identification of another person in claiming to be a citizen of the United States, announced U.S. Attorney David L. Huber of the Western District of Kentucky.

Joseph H. McKinley, Jr., Judge United States District Court, sentenced Hilario-Colin to 3 years supervised release following incarceration. There is no parole in the federal judicial system.

Hilario-Colin pled guilty and admitted that on March 9, 2006, she falsely represented herself to be a United States citizen when she applied for a job with Burns Janitorial Services Company in Louisville, Kentucky. Specifically, Hilario-Colin knowingly and intentionally checked the box on the I-9 employee verification form indicating that she was a “citizen or national of the United States.” Hilario-Colin checked this box, knowing that she was not a citizen of the United States, but rather a citizen of Mexico.

The identification documents that Hilario-Colin utilized in applying for a job with the Burns Janitorial Services Company was an Indiana state identification card and a social security card with the name Joely Santiago. The social security card was unlawfully obtained from an unknown source and used to obtain the Indiana state identification card. The true owner/holder of the social security card number resides outside the state of Kentucky. Hilario-Colin admitted to ICE Special Agents she is a citizen of Mexico and entered the United States illegally.

Upon serving her sentence Hilario-Colin will enter deportation proceedings to be removed from the United States back to Mexico.

The case is being prosecuted by Assistant United States Attorney Daniel P. Kinnicutt, and it was investigated by Immigration and Customs Enforcement, Department of Homeland Security.
