LOUISVILLE PHYSICIAN INDICTED FOR SELLING DRUG SAMPLES
– Physician was paid over $600,000 for drugs
LOUISVILLE, KY - U.S. Attorney David L. Huber of the Western District of Kentucky announced today that a federal grand jury in Louisville returned an indictment on July 8, 2008, against Robert L. Nold, age 70, of Louisville, Kentucky, in Jefferson County, on charges of health care fraud and prohibited drug acts.
The Indictment alleges that between 2003 and 2006, Nold, a physician, sold or traded prescription drug samples to a local pharmacist, Brian Ullom, who has previously pled guilty to the purchase of the drug samples. During the course of the investigation, it was determined that Nold had been paid over $600,000.00 for the sale of the samples. The samples were then placed in Ullom's inventory and they were later sold to consumers whose insurances were billed including Medicare and Medicaid.
In the event of a conviction, the maximum potential penalties are 10 years imprisonment, a $250,000 fine, and supervised release for a period of up to 3 years.
The case is being prosecuted by Assistant United States Attorney Lettricea Jefferson-Webb, and it was investigated by the U.S. Food & Drug Administration Office of Criminal Investigations, Health and Human Services Office of the Inspector General, and the Federal Bureau of Investigation.
Nold was arraigned before the United States Magistrate Judge on July 22, 2008, at 9:30 a.m., in Louisville, Kentucky.
Brian Ullom plead guilty on May 3, 2007 to health care fraud, selling prescription samples and making illegal campaign contributions. He is scheduled to be sentenced on August 15, 2008 at 1:30 p.m.

only and that person is presumed innocent until and unless
proven guilty.
