NEW ORLEANS MAN SENTENCED TO 14 MONTHS IN FEDERAL PRISON FOR RECEIVING A FIREARM WHILE UNDER INDICTMENT

ALFRED PENNINGTON, IV, 21, of New Orleans, Louisiana, was sentenced by U. S. District Judge Sarah S. Vance to fourteen (14) months imprisonment for receiving a firearm while under indictment, announced U. S. Attorney Jim Letten.

According to the factual basis, on January 25, 2007, ALFRED PENNINGTON, IV, was stopped for littering by the Louisiana State Police while driving a 2003 Infinity Coupe in the vicinity of the French Quarter. The littered item turned out to be a bag of suspected marijuana. After PENNINGTON’S arrest, troopers seized a loaded .45 caliber handgun under the driver’s seat. At the time, PENNINGTON was under an Information in Orleans District Court and charged with possession of cocaine. He was prohibited under federal law from receiving a firearm while his case was pending.

The Court imposed a sentence within the recommended guidelines range. After sentencing, ALFRED PENNINGTON, IV was remanded to the custody of the United States Marshals Service to begin his term of imprisonment.

The case was investigated by the Louisiana State Police and the Bureau of Alcohol, Tobacco, Firearms and Explosives as part of the Department of Justices Violent Crime Task Force. The case was prosecuted by Assistant U.S. Attorney Richard W. Rose as part of Project Safe Neighborhood.
