ATF ARREST LEADS TO FEDERAL GRAND JURY INDICTMENT OF MOTHER AND SON FOR FEDERAL GUN VIOLATIONS

MARK RICHBURG, age 27, and BETTY RICHBURG, age 49, residents of New Orleans, Louisiana, were charged in a two-count indictment by a Federal Grand Jury with violations of the Federal Gun Control Act, announced U. S. Attorney Jim Letten.

Specifically, the indictment alleges that MARK RICHBURG and BETTY RICHBURG conspired to make false statements to a firearms dealer, and in fact, made false statements to a firearms dealer in order to illegally obtain a firearm.

According to court documents, on September 15, 2007, BETTY RICHBURG and her son, MARK RICHBURG, went to the Jefferson Gun Outlet located at 501 David Drive, Metairie, Louisiana, to illegally obtain a gun for MARK RICHBURG, a convicted felon and a person prohibited from possessing a firearm under Federal law. The indictment alleges that BETTY RICHBURG executed a Department of Justice, Bureau of Alcohol, Tobacco, and Firearms Form 4473, representing that she was the purchaser of the firearm, when in fact the firearm was purchased by and for MARK RICHBURG.

If convicted of Count 1, BETTY RICHBURG and MARK RICHBURG face a maximum term of imprisonment of five (5) years, a $250,000 fine, and three (3) years supervised release. IF convicted of Count 2, the defendants face a maximum penalty of ten (10) years imprisonment, a fine of $250,000.00 and three (3) years of supervised release following any term of imprisonment.

U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendants must be proven beyond a reasonable doubt.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution is being handled by Assistant U. S. Attorney Liz Privitera of the Violent Crime Unit.
