FELON IN POSSESSION OF A FIREARM SENTENCED
THURSDAY, JUNE 5, 2008 - GRAND RAPIDS, Mich. – Demario Leroy Brown, 24, of Muskegon, was sentenced June 4, 2008, to 37 months in prison for being a felon in possession of a firearm, U.S. Attorney Charles R. Gross announced today.
Brown pled guilty on Jan. 3, 2008, to illegally possessing a .22 caliber revolver. On July 21, 2007, Muskegon Heights police officers observed Brown exit the driver’s side of a van at a service station. Brown staggered and appeared intoxicated. As Brown got back into the driver’s seat of the van, officers told him to get out of the vehicle. Brown ignored the officers and sped off, leading to a chase in which Brown’s vehicle became disabled on a set of train tracks. A loaded .22 handgun was found on the floor of the van near the accelerator and break pedal. Brown, who had previously been convicted for home invasion, was indicted by a federal grand jury on November 27, 2007 for being a felon in possession of a firearm.
U.S. District Judge Janet T. Neff ordered Brown to serve 37 months in prison to be followed by 3 years of supervised release.
U.S. Attorney Gross commended the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) and the Muskegon Heights Police Department for their work on the case. U.S. Attorney Gross noted that “the citizens of Western Michigan should understand that we remain fully committed to vigorously enforcing the federal laws against the illegal possession of firearms by convicted felons.”
This case was prosecuted on behalf of the United States of America by Assistant U.S. Attorney Michael L. Schipper.
