FELON IN POSSESSION OF A SAWED-OFF SHOTGUN
SENTENCED TO EIGHT YEARS IN PRISON



JUNE 18, 2008 - GRAND RAPIDS, Mich. – Kyle Dwayne Mosley, 22, of Muskegon was sentenced to 96 months (8 years) in federal prison for being a felon in possession of a firearm, U.S. Attorney Charles R. Gross announced today. Chief U.S. District Court Judge Robert Holmes Bell, who sentenced Mosley, also ordered that Mosley serve three years of supervised release once he gets out of prison.

Mosley pled guilty on March 6, 2008, to illegally possessing a Harrington & Richardson, Model 88, 20-gauge “sawed-off” shotgun. On September 26, 2007, Muskegon Heights police responded to a report of a person aiming a shotgun at another individual. When officers arrived, Mosley began to run, ignoring orders to stop and surrender. While fleeing from police, Mosley suffered a self-inflicted gunshot wound to the thigh. The shotgun had been shortened to an overall length of 16 inches with a barrel length of about 12 inches.

U.S. Attorney Gross commended the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Muskegon Heights Police Department for their work on the case. U.S. Attorney Gross noted, “The residents of the Muskegon area are the direct beneficiaries of this cooperative effort between state and federal agencies. Mr. Mosley’s case represents yet another successful prosecution of violent criminals through the Project Safe Neighborhoods initiative of the UnitedStates Attorney’s office.”

This case was prosecuted on behalf of the United States by Assistant U.S. Attorneys Philip J. Green and Christopher M. O’Connor.
