BUSINESSMAN PLEADS TO FALSE PENSION REPORT FELONY OFFENSE
THURSDAY, March 13, 2008 -
GRAND RAPIDS, Mich. – M. Jack Fleming, 72, of Kalamazoo, Michigan, entered a
guilty plea to a felony indictment which charged him with filing a false report with the
Department of Labor concerning a employee retirement benefit plan, U.S. Attorney Charles R.
Gross announced today. Mr. Fleming was indicted by a federal grand jury on February 28, 2008,
following an investigation conducted by the Employee Benefits Security Administration of the
United States Department of Labor, based in Fort Wright, Kentucky.
Mr. Fleming faces a maximum criminal penalty of five years imprisonment, a term of supervised release of three years, restitution of approximately $176,000, a fine of $250,000 and a mandatory special assessment of $100. U.S. Magistrate Judge Joseph G. Scoville presided over the guilty plea. The Honorable Robert Holmes Bell, Chief U.S. District Judge, will determine Mr. Fleming’s ultimate sentence at a hearing on a date yet to be scheduled.
U.S. Attorney Gross commended the Department of Labor’s Paul C. Baumann, Deputy
Regional Director, Susan Fultz, Supervisor, and Investigator Steven Diehl for their work in the
case. This case was prosecuted on behalf of the United States of America by Assistant U.S.
Attorney Michael A. MacDonald.
