ELVEN J. SWISHER FOUND GUILTY IN U.S. FEDERAL COURT
Bill Mercer, United States Attorney for the District of Montana, announced today that on April 9, 2008, in Boise, Idaho, after a 4-day federal district court trial before U.S. District Chief Judge B. Lynn Winmill, ELVEN J. SWISHER, a 71-year-old resident of Cottonwood, Idaho, was found guilty of one count of wearing unauthorized military medals, one count of presenting false statements to the Department of Veterans Affairs, one count of presenting false documents to the Department of Veterans Affairs, and one count of theft of government funds. Sentencing is set for June 26, 2008. SWISHER is currently released on special conditions.
SWISHER faces possible penalties of 10 years in prison, a $250,000 fine and 3 years supervised release.
Special Attorney to the U.S. Attorney General Jessica T. Fehr prosecuted the case for the United States.
The investigation was conducted by the U.S. Department of Veterans Affairs, Office of Inspector General. # # # #
