EVAN MAUCH SENTENCED IN U.S. DISTRICT COURT


Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Billings, on April 24, 2008, before Chief U.S. District Judge Richard F. Cebull, EVAN MAUCH, a 48-year-old resident of Billings, appeared for sentencing. MAUCH was sentenced to a term of:

MAUCH was sentenced in connection with his guilty plea to conspiracy to possess with the intent to distribute and distribution of methamphetamine.

At the sentencing proceeding, the government stated it would have proved at trial the following:

From an unknown date in 2003, to April 4, 2006, MAUCH was involved in a conspiracy with several other individuals to distribute over 500 grams of a mixture or substance containing a detectable amount of methamphetamine, or 50 grams of actual methamphetamine, in the Billings area.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that MAUCH will likely serve all of the time imposed by the court. In the federal system, MAUCH does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

Assistant U.S. Attorney James E. Seykora prosecuted the case for the United States.

The investigation was a cooperative effort between the Drug Enforcement Administration, the Montana Department of Criminal Investigation, the High Intensity Drug Trafficking Area (HIDTA) Task Force, and the Billings Big Sky Safe Streets Task Force.
