HENRY LYNN MATTHIES and JUDY MATTHIES SENTENCED IN U.S. DISTRICT COURT
Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Billings, on May 1, 2008, before Chief U.S. District Judge Richard F. Cebull, HENRY LYNN MATTHIES and JUDY MATTHIES, residents of Laurel, appeared for sentencing.
HENRY MATTHIES was sentenced to a term of:
- Prison: 36 months
- Special Assessment: $150
- Restitution: $207,724.01
- Supervised Release: 3 years
JUDY MATTHIES was sentenced to a term of:
- Prison: 24 months
- Special Assessment: $100
- Restitution: $204,520.39
- Supervised Release: 3 years
They were sentenced after having been found guilty during a 3-day trial of conspiracy to defraud the federal government. HENRY MATTHIES was also found guilty of willful failure to file tax returns.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that they will likely serve all of the time imposed by the court. In the federal system, they do have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
First Assistant U.S. Attorney Kurt G. Alme prosecuted the case for the United States.
The investigation was conducted by the Criminal Investigation Division of the Internal Revenue Service.
