MARTIN GARCIA RE-SENTENCED IN U.S. DISTRICT COURT


Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Billings, on July 24, 2008, before Chief U.S. District Judge Richard F. Cebull, MARTIN GARCIA appeared for re-sentencing. GARCIA was sentenced to a term of:

GARCIA was re-sentenced after having been found guilty during a 5-day trial of conspiracy to possess with intent to distribute methamphetamine, possession with intent to distribute and distribution of methamphetamine and possession of a firearm in furtherance of a drug trafficking crime after his original sentence was appealed to the Ninth Circuit Court of Appeals. The sentence was reversed and remanded back to U.S. District Court for re-sentencing.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that GARCIA will likely serve all of the time imposed by the court. In the federal system, GARCIA does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
