VINCENT MARTINEZ RE-SENTENCED IN U.S. DISTRICT COURT
Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Billings, on July 30, 2008, before Senior U.S. District Judge Jack D. Shanstrom, VINCENT MARTINEZ, age 47, appeared for re-sentencing. MARTINEZ was sentenced to a term of:
- Prison: 300 months
- Special Assessment: $100
- Supervised Release: 5 years
MARTINEZ was re-sentenced after his original sentence for conspiracy to possess with the intent to distribute methamphetamine and the use or possession of a firearm during a drug-trafficking crime or in furtherance of a drug-trafficking crime was appealed to the Ninth Circuit Court of Appeals. The sentence was reversed and remanded back to U.S. District Court for re-sentencing.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that MARTINEZ will likely serve all of the time imposed by the court. In the federal system, MARTINEZ does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
