Friday - May 9, 2008 United States Attorney George E.B. Holding announced that in federal court on May 7, 2008, United States District Judge Louise W. Flanagan sentenced ERNEST LEE SMITH, 40, of Bladen County, North Carolina, to 262 months’ imprisonment and three years of supervised release following his term of imprisonment. SMITH was deemed an Armed Career Criminal.
Thursday - May 8, 2008 United States Attorney George E.B. Holding announced that in federal court on May 7, 2008, Chief United States District Judge Louise W. Flanagan sentenced LEE ANTHONY BRAGGS, 39, of Durham, North Carolina, to 254 months’ imprisonment and five years of supervised release following his term of confinement.
Wednesday - May 7, 2008 United States Attorney George E.B. Holding announced that in federal court yesterday Senior United States District Judge W. Earl Britt sentenced CHARLIE O’BRYANT TERRY, 22, of Henderson, North Carolina, to 180 months’ imprisonment.
Tuesday - May 6, 2008 United States Attorney George E.B. Holding announced that in federal court Senior United States District Judge W. Earl Britt sentenced five defendants in the Mobile Billboard scheme.
Tuesday - May 6, 2008 United States Attorney George E.B. Holding announced that in federal court BRANDON LEE MCMILLIAN, 28, of Red Springs, North Carolina, pled guilty before Senior United States District Judge W. Earl Britt for possession of a firearm by a convicted felon.
Tuesday - May 6, 2008 United States Attorney George E.B. Holding announced that yesterday in federal court ANTHONY HASSAN RUSSELL, 24, of West Palm Beach, Florida, entered his guilty plea before United States District Judge James C. Dever, III, for conspiring to possess with intent to distribute controlled substances and the use and carrying of a firearm in relation to a drug trafficking crime.

Holding announced that yesterday in federal court MITCHELL SWAIN, 41, of Plymouth, North Carolina, pled guilty before United States District Judge James C. Dever, III to conspiring to distribute and possession with the intent to distribute more than 50 grams of cocaine base (crack) and a quantity of cocaine, in violation of Title 21, United States Code, Section 846.
Thursday - May 1, 2008 United States Attorney George E.B. Holding announced that in federal court RAJESH THELABHAI PATEL, 35, of Fayetteville, North Carolina pled guilty on April 29, 2008, before United States District Judge Terrence W. Boyle to conspiracy to distribute and possess with intent to distribute five kilograms or more of cocaine and a quantity of marijuana.

Boyle sentenced SHAHZAD MATHUR, 34, of Greenville, South Carolina, to 240 months’ imprisonment and five years supervised release following his term of confinement.
Wednesday - April 30, 2008 United States Attorney George E.B. Holding announced that yesterday a federal Criminal Information was filed charging James O. McLamb, Jr., 41, of Raleigh, North Carolina, Chief Financial Officer/Chief Operating Officer (CFO/COO), of The Castleton Group (“Castleton”), with tax conspiracy, in violation of Title 18, United States Code, Section 371.
Friday - April 25, 2008 United States Attorney George E.B. Holding announced that a Federal Grand Jury returned a Criminal Indictment on April 17, 2008 charging ANTHONY TERRELL RUSSELL, 23, BRANDON MICHAEL JONES, 20, and ASHLEY LAMONT BOST, 20, all from Raleigh, North Carolina, with conspiring and attempting to possess with the intent to distribute controlled substances, in violation of Title 21, United States Code, Section 846, which carries a maximum term of imprisonment of 20 years, 3 years supervised release, and $1,000,000 fine; and using and carrying firearms during and in relation to drug trafficking crimes, and aiding and abetting, in violation of Title 18, United States Code, Section 924(c)(1)(A) and 2, which carries a maximum term of life imprisonment, 5 years supervised release, and a $250,000 fine.
Thursday - April 24, 2008 United States Attorney George E.B. Holding announced that yesterday in federal court United States District Judge James C. Dever, III, sentenced defendant MARGARET HAMILTON, 45, of Louisburg, North Carolina, to 72 months’ imprisonment and five years of supervised release.
Thursday - April 24, 2008 The United States Attorney for the Eastern District of North Carolina, George E.B. Holding announced yesterday that a federal jury in Los Angeles, California, found AVEDIS DJEREDJIAN, 39, of Glendale, California, guilty on 15 counts for conspiring to traffic in contraband cigarettes, in violation of Title 18, United States Code, Section 371; conspiring to violate Title 18, United States, Code, Section 1956 (a)(1)(A)(I) by conducting financial transactions with the intent to promote the carrying on of specified unlawful activity, in violation of Title 18, United States Code, Section 1956(h); and structuring financial transactions and aiding and abetting, in violation of Title 31, United States Code, Sections 5324(a)(3) and 5324 (d).

Holding announced that yesterday in federal court ROBERT HAMPTON TAYLOR, 52, of Fayetteville, North Carolina, pled guilty before United States District Judge James C. Dever, III, to possession of a firearm in furtherance of a conspiracy to commit robbery, in violation of Title 18, United States Code, Section 924(c), and felon in possession of a firearm in violation of Title 18, United States Code, Section 922(g).

Fox sentenced SHANE MARCUS HUNT, 36, of Lumberton, North Carolina, to 390 months’ imprisonment and five years supervised release following his term of confinement.

Boyle sentenced TIFFANY LAROSE TAYLOR, 33, of Duplin County, North Carolina, to 180 months’ imprisonment and five years supervised release following her term of confinement.

Holding announced that the following former officers of the Robeson Country Sheriffs Office: RICKY LYNN BRITT, 42, of Fairmont, North Carolina and ROBERT IVEY, 48, of Lumberton, North Carolina were re-sentenced in federal court before United States District Judge Terrence W. Boyle.

Flanagan sentenced MARVIN MAROQUIN-BRAN, 44, a native of Guatemala, to 57 months’ imprisonment for illegally re-entering the United States after being previously convicted of an aggravated felony.

Flanagan sentenced GERALD THOMAS SMITH, 37, of Spring Hope, Nash County, North Carolina, to 480 months’ imprisonment for transmitting child pornography and obscene materials over the internet.

Holding announced that yesterday in federal court FORREST DALE PORTER, 57, of Boomer, North Carolina; TIMOTHY WAYNE ROBERTS, 43, of Franklinton, North Carolina; and BRANDON KEITH HARRIS, 22, of Franklinton, North Carolina, pled guilty before Senior United States District Judge James C. Fox for conspiring to transport stolen merchandise valuing $5,000 or more across state lines and aiding and abetting that crime, in violation of Title 18, United States Code, Section 371.

Holding announced that in federal court Chief United States District Judge Louise Wood Flanagan sentenced MARIE CAMBRONNE, 26, of Margate, Florida, to time served, with three years of supervised release and NICOLE ROSENTHAL, 32, of Sunrise, Florida, to 16 months’ imprisonment and 3 years supervised release following her term of incarceration.
Tuesday - April 15, 2008 BRIAN CURTIS AUTRY, 26, of Raleigh, North Carolina, plead guilty before Senior United States District Judge James C. Fox to possession with intent to distribute more than 50 grams of crack cocaine, in violation of Title 21, United States Code, Section 841(a)(1), which carries a penalty of 10 years to life in prison and a $4,000,000.00 fine and possession of a firearm in furtherance of a drug trafficking crime, in violation of Title 18, United States Code, Section 924, carrying a penalty of 5 years to life in prison and a $250,000.00 fine.
Thursday - April 9, 2008 United States Attorney George E.B. Holding announced that in federal court Chief United States District Judge Louise Wood Flanagan sentenced three brothers from New Bern for conspiracy to distribute more than 50 grams of cocaine base.
Tuesday - April 8, 2008 United States Attorney George E.B. Holding announced that yesterday in federal court Senior United States District Judge W. Earl Britt sentenced JOHN CLYDE BRITT, JR., 53, of Saint Pauls, North Carolina, to 188 months’ imprisonment and three years supervised release following his term of confinement.

Tuesday - April 7, 2008 United States Attorney George E.B. Holding announced that in federal court LUIS JUAREZ-DIAZ, 32, CLAUDIO DANIEL SANDOVAL-GOMEZ, 27, CARLOS CABALLERO-FRANCO, 24, and FABIAN ARTURO RAMIREZ-GALVAN, 24, all illegal aliens residing in and around the Raleigh-Durham area, were arraigned before United States District Judge James C. Dever, III, and pled guilty to conspiring to produce and transfer false documents appearing to have been issued by or under the authority of the United States, conspiring to possess with intent to unlawfully transfer five or more false identification documents, and conspiring to possess document-making implements suited for making false identification documents, all in violation of Title 18, United States Code, Section 1028(f).
Friday - April 4, 2008* PACCSHIP, the operator and manager of approximately ten ships that regularly carry goods between Asia and ports in the United States, pleaded guilty today and was sentenced to pay a $1.7 million fine for crimes related to improper transfers and discharges of oil-contaminated waste from two of its ships, announced Ronald J. Tenpas, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division and George E. B. Holding, U.S. Attorney for the Eastern District of North Carolina.

Friday - April 4, 2008 United States Attorney George E.B. Holding announced that on March 19, 2008, a federal Grand Jury returned a 45-count Criminal Indictment charging PAMELA D. EVANS, 33; GWENDOLYN P. EVANS, 49; TASHA BATTLE, 28; and BERTHA BATTLE, 28, all of Rocky Mount, North Carolina, with conspiracy to defraud the United States by obtaining fraudulent claims from the Internal Revenue Service, in violation of Title 18, United States Code, Section 286, and making false, fictitious or fraudulent claims against the United States, in violation of Title 18, United States Code, Section 287.

Holding announced that yesterday a federal Grand Jury returned a three-count Criminal Indictment on PERRY REESE, III, 49, of Roseboro, North Carolina, charging two counts of distribution of a controlled substance, in violation of Title 21, United States Code, Section 841(a)(1) and one count of racketeering activity, in violation of Title 18, United States Code, Section 1962(c).

Boyle to conspiracy to violate the International Emergency Powers Act (IEEPA), Title 50, United States Code, Section 1702 and 1705, Title 31, Code of Federal Regulations, Sections 560.203, 560.204 and 560.205 and 18 United States Code Section 371.
