Jayant Patel Arrested Today by FBI
 

Portland, Ore. - Jayant Mukundray Patel, 57, was arrested today without incident at his home in Oregon by agents of the Federal Bureau of Investigation.  He appeared in court before United States Magistrate Judge Dennis J. Hubel on the basis of an Extradition Complaint.  The court detained the defendant pending a detention hearing scheduled for March 13, 2008 at 1:30 p.m. before Judge Hubel to determine whether the defendant should be released pending the extradition hearing.  An extradition hearing is scheduled for April 10, 2008 at 9:30 a.m. before United States Magistrate Judge Paul Papak.
 
            The government of Australia is seeking extradition of Patel to face charges arising from Patel’s employment as a doctor at Bundaberg Base Hospital in Brisbane, Australia.  Patel is charged in Australia with:

  • three counts of manslaughter, contrary to sections 300 and 303 of the Queensland Criminal Code, carrying a maximum penalty of life imprisonment;
  • three counts of grievous bodily harm, contrary to section 320 of the Queensland Criminal Code, carrying a maximum penalty of 14 years imprisonment;
  • two counts of negligent acts or omissions causing harm, contrary to section 328 of the Queensland Criminal Code, carrying a maximum penalty of 2 years imprisonment;
  • five counts of fraud, contrary to section 408C of the Queensland Criminal Code, carrying a maximum penalty of 5 years imprisonment;
  • two counts of fraud valued at over $5,000, contrary to section 408C of the Queensland Criminal Code, carrying a maximum penalty of 10 years imprisonment; and
  • one count of attempted fraud, contrary to sections 4, 535, and 408C of the Queensland Criminal Code, carrying a maximum penalty of 2 1/2 years imprisonment.

            The government has filed an Extradition Complaint, a Memorandum in Opposition to Bail, and an Extradition Memorandum with the United States District Court Clerk, along with materials from the Australian government filed in support of the extradition.  Click on link to see a copy of The Extradition Complaint, Bail Memorandum and Extradition Memorandum.
