Portland, Ore. - David Olander, 54, of Portland, was sentenced yesterday in federal court before U.S. District Judge Garr M. King to a term of 60 months in prison to be followed by a 60 month term of supervised release. Defendant had previously entered a plea of guilty to the crimes of receipt of child pornography and possession of child pornography.
On January 18, 2006, Olander was indicted by a federal grand jury on two counts of receipt of child pornography and possession of child pornography. Defendant’s charges arose from allegations that he accessed and paid for child pornography from two websites which were the subject of a separate government investigation. Olander’s credit card and other identifying information were found in the search of the billing data associated with the website. A separate, similar investigation found the same information, thereby demonstrating that defendant had, on two occasions, paid for access and subscriptions to websites the sole purpose of which were to make child pornography available for a fee.
Subsequent to a search warrant, resulting in the arrest and indictment of both defendant and his brother, defendant’s computer was forensically reviewed for its contents. During that review, agents discovered more than 1,000 images containing depictions of child pornography, including videos portraying children under the age of 12 and children engaged in sado-masochistic conduct. During an interview of defendant, he admitted to accessing the websites and downloading the child pornography from the Internet.
This case was investigated by the U.S. Immigration and Customs Enforcement (ICE) and prosecuted by Assistant U.S. Attorney Greg Nyhus.
