YORK COUNTY CONSTABLE PLEADS GUILTY TO FAILING TO FILE INCOME TAX RETURNS FOR FIVE YEARS Martin C. Carlson, Acting United States Attorney for the Middle District of Pennsylvania, announced today that Kelly L. Deardorff, age 42, of York, Pennsylvania, pleaded guilty in federal court to five counts of failing to file his federal income tax returns for the years 2001 through 2005. The guilty plea was entered before Magistrate Judge J. Andrew Smyser. As a result of the guilty plea, Deardorff faces up to five years’ imprisonment, fines totaling $500,000 and will be required to pay all taxes, penalties and interest due the IRS. Deardorff is an elected constable in York County, Pennsylvania and is paid by York County, several district justices and private attorneys for serving legal documents, executing warrants and other related activities. Deardorff admitted that he earned $117,871.69 in 2001; $130,153.02 in 2002; $130,193.77 in 2003; $145,932.06 in 2004; and $155,966.89 in 2005 but failed to file income tax returns for any of those years despite being required to do so. The case was investigated by the Criminal Investigation Division of the IRS and is assigned to Assistant United States Attorney Bruce Brandler for prosecution. **** |
