All court events in this case (e.g. trial, sentencing hearing, etc.) will take place at the United States District Courthouse, 700 Stewart St., Seattle, Washington. If you are planning to attend any of the court proceedings, please contact the Victim-Witness Unit at (800) 797-6722. Note that scheduled court events can be changed at very short notice. If you plan to attend any of the events listed below, we strongly recommend that you call the above toll-free line the day before the court event to verify that it is still taking place as originally scheduled.

7/23/02 

Defendant Kevin McCarthy pleads guilty to an Information charging him with mail fraud and conspiracy to commit securities, mail and wire fraud, and money laundering. Mr. McCarthy is currently scheduled to be sentenced at 10:00 a.m. on November 14, 2003, before the Honorable Marsha J. Pechman.

7/30/02 

Defendant Clifford G. Baird pleads guilty to an Information charging him with conspiracy to commit securities, mail and wire fraud, and money laundering. Defendant Donavon C. Claflin pleads guilty to an Information charging him with securities fraud and conspiracy to commit securities fraud, mail fraud, and unlawful sale of unregistered securities. Defendants Baird and Claflin are both scheduled to be sentenced on November 14, 2003, beginning at 9:00 a.m., before the Honorable Marsha J. Pechman.

7/31/02 

A federal grand jury in Seattle returned a 64-count Indictment against Kevin L. Lawrence. The Indictment charges Lawrence with securities fraud, wire fraud, mail fraud, money laundering and conspiracy to commit these crimes. Mr. Lawrence is presumed innocent of the charges against him until proven guilty. A press release regarding the charges was issued on August 1, 2002.

8/1/02 

Defendant Kevin L. Lawrence is arraigned on the charges against him, and pleads not guilty. As a result, a jury trial has been scheduled to begin on September 22, 2003, before the Honorable Marsha J. Pechman.

12/10/02 

Defendant James N. Wuensche, pleads guilty to an Information charging him with one felony criminal count of conspiracy to commit securities fraud, mail fraud, wire fraud, and money laundering. A press release regarding these charges was issued on December 10, 2002. Defendant Wuensche is currently scheduled to be sentenced on November 14, 2003, at 1:30 p.m., before the Honorable Marsha J. Pechman.

3/26/03

A federal grand jury in Seattle returned a 114-count Superseding Indictment charging four additional defendants, along with Kevin L. Lawrence, with Securities Fraud, Wire Fraud, Mail Fraud, two forms of Money Laundering, and Conspiracy to Commit these offenses and the Unlawful Sale of Unregistered Securities. The four additional defendants are Steven J. Reimer, Larry L. Beaman, Michael J. Culp, and Harvey W. Kuiken. A press release regarding the charges was issued on March 27, 2003. A press release regarding the criminal complaint filed against Harvey W. Kuiken was released on February 19, 2003.

3/27/03

Timothy T. Moody was charged by Criminal Complaint with one count of Wire Fraud. Moody is the tenth defendant charged in connection with the Znetix case. A press release regarding this charge was issued on March 31, 2003.

4/1/03

Defendants Steven J. Reimer, Larry L. Beaman, Michael J. Culp, Kevin L. Lawrence and Harvey W. Kuiken were arraigned before Magistrate Judge John L. Weinberg. All five defendants pleaded not guilty to the charges filed against them in the Superseding Indictment on March 26, 2003. As a result, a trial date for all five defendants was set for September 22, 2003. The public is reminded that the Superseding Indictment against the defendants contains only allegations, and that all defendants must be proven guilty beyond a reasonable doubt in a court of law.

Defendants Reimer, Beaman, Culp and Kuiken were released on bond with supervision pending trial. Defendant Lawrence remains in custody pending trial.

4/23/03 - 6/5/03

Timothy Moody was Indicted on three counts of Wire Fraud. At his arraignment, Mr. Moody pleaded not guilty to the charges against him. As a result, a jury trial for this defendant has been set for October 20, 2003, before the Honorable Marsha J. Pechman. The defendant remains in custody pending trial.

6/12/03

The trial date for defendants Kevin L. Lawrence, Steven J. Reimer, Michael J. Culp, Larry L. Beaman and Harvey W. Kuiken has been continued. The trial is now set to begin on March 22, 2004, before the Honorable Marsha J. Pechman. Defendants Lawrence, Reimer and Culp remain in custody pending trial. Defendants Beaman and Kuiken were released on bond pending trial.

The sentencing hearing dates for defendants Clifford Baird, Donavon C. Claflin, Kevin McCarthy and James N. Wuensche remain set for November 14, 2003, before the Honorable Marsha J. Pechman.

6/17/03

A federal grand jury in Seattle returned a 114-count Second Superseding Indictment charging two additional defendants, Alfonso Lacson, Jr. and Alex Lacson, along with five previously indicted defendants - Kevin L. Lawrence, Steven J. Reimer, Larry L. Beaman, Michael J. Culp, and Harvey W. Kuiken- with Securities Fraud, Wire Fraud, Mail Fraud, and Conspiracy to Commit these offenses and the Unlawful Sale of Unregistered Securities. The five previously indicted defendants were also charged with money laundering. Each defendant is charged with some but not all counts. Defendants Lawrence, Reimer, and Culp remain in custody pending trial set for March 22, 2004.

7/21/03

Defendant Timothy T. Moody pleaded guilty to one count of Wire Fraud in connection with his employment by Znetix, Inc., and is due to be sentenced on October 17, 2003, before the Honorable Marshal J. Pechman, United States District Court, Seattle, Washington. The defendant remains in custody pending sentencing.


7/28/03

Defendant Kevin L. Lawrence pleaded guilty to three felony criminal offenses: 1) Conspiracy to Commit Securities Fraud, Wire Fraud, Mail Fraud, Unlawful Sale of Unregistered Securities, Money Laundering, and Engaging in Monetary Transactions with Proceeds of Unlawful Activity; 2) Securities Fraud; and 3) Wire Fraud. The plea agreement provides that the government will recommend that the Court impose a sentence of 20 years imprisonment. The sentencing date listed in the press release is no longer correct. Sentencing for defendant Lawrence has been re-set for November 7, 2003, before the Honorable Marshal J. Pechman. The defendant remains in custody pending sentencing. .

9/30/03

Defendant Steven J. Reimer pleads guilty (view plea agreement). Sentencing hearing is set for January 9, 2004, at 10:00 a.m. before the Honorable Marsha J. Pechman.

10/10/03

There have been a number of continuances affecting this case. Updated information is listed below.

Jury trial for defendants Larry L. Beaman, Michael J. Culp, Harvey W. Kuiken, Alex Lacson and Alfonso Lacson, Jr. is set to begin March 22, 2004 @ 9:00 a.m.

The public is reminded that the charges against the above defendants contain only allegations, and that all defendants must be proven guilty beyond a reasonable doubt in a court of law.

The following defendants have all pleaded guilty, and are awaiting final sentencing:

Sentencing hearing for defendant Kevin Lawrence has been continued to November 7, 2003 @ 9:00 a.m.

Sentencing hearing for defendant Timothy T. Moody has been continued to November 21, 2003 @ 9:00 a.m.

Sentencing hearing for defendant James N. Wuensche has been continued to December 11, 2003 @ 4:00 p.m.

Sentencing hearing for defendants Clifford G. Baird, Donavon C. Claflin and Kevin McCarthy has been continued to April 30, 2004.

All of the above events will be held before the Honorable Marsha J. Pechman, United State District Court, Seattle, Washington.

Sentencing hearing for Kevin Lawrence has been continued to November 25, 2003, at 9:00 a.m . before the Honorable Marshal J. Pechman.

10/23/03

Defendant Tim Moody's sentencing has been rescheduled to November 26, 2003, at 10 a.m.

11/04/03

The sentencing hearing for defendant Timothy Moody has been continued to December 5, 2003, at 2:15 p.m. before the Honorable Marsha J. Pechman.

11/25/03

Defendant Kevin L. Lawrence was sentenced today by the Honorable Marsha J. Pechman to 20 years incarceration, followed by 3 years of supervised release. Lawrence was also ordered to pay over $91 million in restitution. For more information, view the Judgment.

12/1/03

The sentencing hearing for defendant Steven J. Reimer has been continued to April 30, 2004, at 1:30 p.m. before the Honorable Marsha J. Pechman.

The sentencing hearing for defendant James N. Wuensche has been continued to January 23, 2004 before the Honorable Marsha J. Pechman.

12/8/03

Defendant Timothy Moody was sentenced by the Honorable Marsha J. Pechman to 37 months in prison, followed by 3 years of supervised release. Mr. Moody was also ordered to pay $2,484,000 in restitution.

12/9/03

Defendant Alex Lacson entered a felony guilty plea today before federal Magistrate Judge Mary Alice Theiler. The defendant pleaded guilty to felony obstruction of the investigation conducted by the SEC regarding the activities of individuals associated with Znetix, Inc., Health Maintenance Center, Inc. and affiliated companies. Alex Lacson is scheduled to be sentenced on May 28, 2004, at 11:00 a.m. before the Honorable Marsha J. Pechman.

1/9/04

Defendant Alfonzo D. Lacson, Jr. pleaded guilty to Securities Fraud in connection with the offer and sale of securities issued by Health Maintenance Centers, Inc. (HMC), a company affiliated with Znetix, and is due to be sentenced on April 16, 2004, before the Honorable Marsha J. Pechman, United States District Court, Seattle, Washington.

1/23/04

Defendant James N. Wuensche was sentenced by the Honorable Marsha J. Pechman to 5 years in prison, followed by 3 years of supervised release. Mr. Wuensche was also ordered to pay $10,800,000 in restitution. For more information, view the Judgment.

Jury trial for defendants Harvey W. Kuiken, Larry L. Beaman and Michael J. Culp continues. The sentencing hearing for defendant Alfonzo D. Lacson, Jr. has been continued to April 30, 2004 at 2:30 p.m. before the Honorable Marsha J. Pechman.

5/4/04

The jury trial for defendants for defendants Harvey W. Kuiken, Larry L. Beaman and Michael J. Culp continues.

The evidentiary hearing for defendant Alex Lacson regarding the defendant's motion to withdraw his guilty plea is set for May 13, 2004, at 1:30 p.m. before the Honorable Marsha J. Pechman, United States District Court, Seattle, Washington.

The evidentiary/sentencing hearing for defendant Alfonso Lacson, Jr., has been continued to July 2, 2004, at 9:00 a.m. before the Honorable Marsha J. Pechman, United States District Court, Seattle, Washington.

5/17/04

Larry L. Beaman was found guilty of 26 felony counts, including Conspiracy, Securities Fraud, Wire Fraud, and Money Laundering.

Michael J. Culp was found guilty on 12 counts including Conspiracy, Securities Fraud, and Money Laundering.

Harvey W. Kuiken was found guilty on 14 counts including Conspiracy, Securities Fraud, and Engaging in Unlawful Monetary Transactions.

Sentencing is set for September 17, 2004, before the Honorable Marsha J. Pechman, United States District Court, Seattle, Washington.

6/21/04

The sentencing hearing for defendant Kevin McCarthy has been continued to July 6, 2004 at 1:30 p.m.

6/22/04

The sentencing for defendant Clifford Baird has been continued to July 23, 2004, at 10 a.m.

The sentencing for defendant Steven J. Reimer has been continued to September 1, 2004 at 4:00 p.m. before the Honorable Marsha J. Pechman, United States District Court, Seattle, Washington.

6/29/04

The sentencing hearing date for defendant Donovan Claflin is continued to July 15, 2004, at 1:30 p.m.

Alex Lacson - Sentencing hearing continued to 8/6/04 at 4:00 p.m. before the Honorable Marsha J. Pechman.

Steven Reimer - Sentencing hearing continued to 9/1/04 at 4:00 p.m. before the Honorable Marsha J. Pechman.

Donovan Claflin - Sentencing hearing continued to 9/24/04 at 3:00 p.m. before the Honorable Marsha J. Pechman.

Michael Culp - Sentencing hearing continued to 10/15/04 at 1:30 p.m. before the Honorable Marsha J. Pechman.

7/28/04

Due to the congestion of the court's schedule, the sentencing hearing for Steven J. Reimer, scheduled for 9/1/04 is rescheduled to 9/10/04 at 9:00 a.m. before the Honorable Marsha J. Pechman.

8/2/04

3/04/05

Defendant Larry L. Beaman was sentenced by the Honorable Marsha J. Pechman to 151 months in prison, followed by 3 years of supervised release. Mr. Beaman was also ordered to pay $5,264,366 in restitution.

Defendant Michael J. Culp was sentenced by the Honorable Marsha J. Pechman to 97 months in prison, followed by 3 years of supervised release. The determination of restitution is deferred until May 7, 2005 at 2:30 p.m. See press release for more information.

Defendant Harvey W. Kuiken was sentenced by the Honorable Marsha J. Pechman to 108 months in prison, followed by 3 years of supervised release. The determination of restitution is deferred until a future date to be set by the court. See press release for more information.

4/18/05

Defendant Alfonso D. Lacson, Jr. was sentenced by the Honorable Marsha J. Pechman to 30 months in prison, followed by 3 years of supervised release. Mr. Lacson was also ordered to pay $623,500 in restitution. See press release for more information.
