UNITED STATES TRUSTEE SYSTEM

The United States Trustee System is relatively new to bankruptcy. Historically, the courts oversaw all aspects of a bankruptcy case. In 1978, Congress passed the Bankruptcy Reform Act which established a system of United States Trustees modeled after the United States Attorney system. Administration of bankruptcy cases was removed from the courts and placed in the Department of Justice under United States Trustees appointed by the Attorney General.

United States Trustees appoint and supervise all the trustees and have standing to appear in all bankruptcy cases. According to legislative history, the purpose of placing all bankruptcy enforcement and administrative responsibilities in the Department of Justice was to leave bankruptcy judges free to resolve disputes untainted by knowledge of matters unnecessary to a judicial determination.

The United States Trustee system began in 18 pilot districts in 1978. Its success led Congress to expand it nationwide in 1986. The Attorney General certified Region 17 on October 20, 1988. One year after certification, the United States Trustee for Region 17 took over the administration of all pending bankruptcy cases in the region.
