Petitions for Review

Petitions for Review: Many of the major pollution-control statutes allow for direct judicial review of regulations and certain other final agency actions in the courts of appeals. These are called “petitions for review” and EDS briefs and argues these cases in courts of appeals nationwide. For example, under the Clean Air Act, this includes regulations addressing greenhouse gas emissions from industrial plants and vehicles, the Environmental Protection Agency’s national ambient air quality standards for ubiquitous pollutants such as ozone, sulfur dioxide and nitrogen dioxide, and regulations involving air pollution transported from State to State. EDS also defends petitions for review of numerous other important agency actions under statutes such as the Clean Water Act, the Resource Conservation and Recovery Act, the Federal Insecticide, Fungicide, and Rodenticide Act, and the Toxic Substances Control Act.
