INVESTIGATION OF ALLEGED LACK OF CANDOR TO THE COURT

A Special Assistant U.S. Attorney allegedly approved and filed a search warrant affidavit that omitted material facts known to her and relied upon evidence that she knew had been suppressed.  Based on the results of its investigation, OPR concluded that the Department attorney committed reckless professional misconduct in violation of her general duty of candor and ethics rules, which both generally require disclosure of material facts in ex parte proceedings.
