1620. Prosecutive Policy -- IPP Cases -- When Death Penalty Is Statutorily Authorized

Several Federal statutes designed to protect foreign officials, internationally protected persons (IPPs), and official guests, authorize imposition of the death penalty where the offense involves the killing of the protected person (see 18 U.S.C. § 1116(a)) or where death results from the offense (see 18 U.S.C. § 1201(a)). In cases where a defendant is charged with an offense for which the death penalty can be imposed, the United States Attorney is required to follow the procedures set out in JM 9-10.000 and transmit to the Attorney General the information required by that section, regardless of whether he or she actually intends to seek the death penalty.
