9-99.000 - Federal Food, Drug, and Cosmetic Act

Various misconduct pertaining to the manufacture, sale, and distribution of food, dietary supplements, drugs, medical devices, tobacco, and cosmetics can be prosecuted criminally under the Federal Food, Drug, and Cosmetic Act, 21 US.C. § 301, et seq.  As set forth at JM 4-1.313 and JM 4-8.200, criminal investigations and prosecutions involving possible violations of the Federal Food, Drug, and Cosmetic Act require notification to, and consultation with, the Consumer Protection Branch of the Civil Division.
